Terms of Service
Welcome to Hearya. These Terms of Service ("Terms") govern your use of the Hearya iOS application (the "App") provided by Ornex Studios ("we," "us," or "our"). By downloading or using Hearya, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use Hearya. By using the App, you represent that you meet this age requirement.
2. Your Account
You sign in to Hearya using Sign in with Apple. You are responsible for maintaining the security of your Apple ID. You agree to notify us promptly of any unauthorized access to your account.
3. Acceptable Use
When using Hearya, you agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or otherwise extract source code from the App
- Interfere with or disrupt the App or its servers
- Use automated systems (bots, scrapers) to access the App
- Submit context or content that is illegal, abusive, harassing, hateful, or otherwise objectionable
- Attempt to manipulate the AI to generate harmful, illegal, or offensive content
4. AI-Generated Content
Hearya uses third-party large language models to generate conversation questions. AI-generated content may occasionally be inaccurate, repetitive, or unexpected. You are responsible for how you use the questions in your own conversations. We do not guarantee that AI-generated questions will be appropriate for every audience or context.
5. Your Content
Optional context you provide when generating packs is owned by you. By submitting it, you grant us a limited license to process it for the purpose of generating questions. We do not use your context to train AI models.
6. Intellectual Property
Hearya, including its branding, design, software, and curated question pool, is owned by Ornex Studios and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Subscription and Payments
Hearya is currently free to download and use. If we introduce paid features or subscriptions, those purchases will be processed through Apple's App Store and governed by Apple's terms in addition to these Terms. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period, manageable in your Apple ID account settings.
8. Termination
You may stop using Hearya and delete your account at any time. We may suspend or terminate your access if you violate these Terms or engage in conduct that harms other users, our service, or third parties.
9. Disclaimers
Hearya is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or that AI-generated questions will meet your specific needs. Hearya is a tool to support conversation — it is not a substitute for professional therapy, counseling, or relationship advice.
10. Limitation of Liability
To the fullest extent permitted by law, Ornex Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.
11. Indemnification
You agree to indemnify and hold harmless Ornex Studios and its affiliates from any claims, damages, or expenses arising from your violation of these Terms or misuse of the App.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Delaware.
13. Apple-Specific Terms
You acknowledge that these Terms are between you and Ornex Studios, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranty, Apple may refund the purchase price, if any. Apple is a third-party beneficiary of these Terms and may enforce them against you.
14. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes through the App or by email. Continued use of Hearya after changes means you accept the updated Terms.
